Understanding marijuana laws in Missouri

Like other states in the nation, Missouri has taken steps to alter its laws regarding marijuana. Specifically, it has authorized the usage of this drug for medicinal purposes. While this has created a whole new perspective when it comes to criminal charges for marijuana possession, the reality is that the passage of this law has not altered the fact that criminal charges could occur if one is suspected to be in possession of marijuana.

In November 2018, Amendment 2 was passed in Missouri. This allowed for the legalization of medical marijuana in the state. Patients authorized to purchase marijuana for medicinal use can purchase at least 4 ounces of marijuana. It can also allow for some patient to grow their own, with the max amount being 6 plants. It is expected that by 2020, there will be around 20,000 medical marijuana patients and 192 licensed dispensaries in the state.

And while there are situations where marijuana possession is legal, it is important to note when it is legal to possess and distribute and when it is illegal. When an individual is found in possession of more than 10 grams of marijuana, he or she could face a potential penalty of a fine of $500 for the first offense. A second offense for possession of more than 10 grams but less than 35 gram of marijuana could result in a year in prison and a fine of up to $2,000.

Additionally, getting caught selling any amount of marijuana is considered a felony and could result in several years of imprisonment and a fine of $10,000. Thus, it is important that those attempting to legally distribute marijuana go through the proper channels and ensure everything is sound and legal.

Facing criminal allegations is a serious matter, no matter the situation. Thus, it is always imperative to gain a full perspective of the situation, understanding what defense options the accused has. With regards to marijuana possession, if the accused was in possession of medicinal marijuana and they have a valid prescription, this information could be very valuable in one's defense to help reduce or dismiss the charges against them.
